A while ago I had the audacity to challenge the statement recorded by our founding fathers in the preamble of the Declaration of Independence; …

“We hold these truths to be (self-evident), ..that (all men) are created equal, that (they are endowed) by their Creator with certain (unalienable) Rights, ..that (among these), ..are Life, Liberty and the pursuit of Happiness.”

According to Merriam-Webster: “au·dac·i·ty,” Bold or insolent heedlessness of restraints.

the 10 Commandments - in stone 1a

Our Creator (the Lord God) gave us the 10 Commandments, he didn’t write the Declaration of Independence, ..or the U.S. Constitution, ..men that put their pants on one leg at a time did that. Men who understood greed corruption and evil, so they penned the Constitution to be followed as the law, not to be judged or interpreted to provide a moment in the life of a future idealist.

According to Webster: “i·de·al·ist,” One whose conduct is influenced by ideals that often (conflict with practical) considerations; One who is “unrealistic and impractical.”

That particular individual (sentence) has become one of the best-known sentences in the English language, containing the most powerful and consequential words in American history.

This one passage has come to represent a moral standard to which the United States strives. This conviction was notably encouraged by Abraham Lincoln, who considered the declaration of independence to be the foundation of his political philosophy, and argued that the declaration is a statement of principles by which the Constitution should be interpreted.

Yet in their January 28, 2012 decision concerning Barack Obama’s signature legislation the; “Patient Protection and Affordable Care Act of 2010,” i.e., Obamacare, ..our current Supreme Court justices literally threw our founding fathers under the bus and went with political expediency.

Specifically, the court held that the individual mandate is not a “penalty,” (as the health-care law identified it), but rather a tax, and therefore a constitutional application of Congress’s taxation power.

Are you kidding me, ..the nine most powerful justices in the United States ruled that it was (fairly possible) that Obama’s “Patient Protection and Affordable Care Act) that provides a (mandate) that individuals have to purchase (a service) and, or, (Health Insurance), ..because they chose to decide that Obama’s “mandate” is a tax instead of a penalty as written.

Even with my measured education, I understanding that our Supreme Court overstepped their constitutional authority by legislating from the bench, ..why didn’t they?
