Constitutional: According to Webster’s, 1. Of or relating to a constitution: a constitutional amendment. 2. Consistent with, sanctioned by, or permissible according to a constitution: a law that was declared constitutional by the court; the constitutional right of free speech. 3. Established by or operating under a constitution: a constitutional government. 4. Of or proceeding from the basic structure or nature of a person or thing; inherent: a constitutional inability to tell the truth. 5. Of or relating to one’s physical makeup. –con·sti·tu·tion·al, A walk taken regularly for one’s health.

 According to Wikipedia, In 1991, Barack Obama accepted a two-year position as Visiting Law and Government Fellow at the University of Chicago Law School to work on his first book. He then served as a professor at the University of Chicago Law School for twelve years, as a Lecturer from 1992 to 1996, and as a Senior Lecturer from 1996 to 2004, teaching Constitutional Law.

 Also according to Wikipedia; Barack Obama was elected to the Illinois Senate in 1996, succeeding State Senator Alice Palmer as Senator from Illinois’s 13th District, which at that time spanned Chicago South Side neighborhoods from Hyde Park, Kenwood south to South Shoreand west to Chicago Lawn. Once elected, Obama gained bipartisan support for legislation reforming ethics and health care laws. He sponsored a law increasing tax credits for low-income workers, negotiated welfare reform, and promoted increased subsidies for childcare. In 2001, as co-chairman of the bipartisan Joint Committee on Administrative Rules, Obama supported Republican Governor Ryan’s payday loan regulations and predatory mortgage lending regulations aimed at averting home foreclosures.

Obama was reelected to the Illinois Senate in 1998, defeating Republican Yesse Yehudah in the general election, and was reelected again in 2002. In 2000, he lost a Democratic primary run for the US House of Representatives to four-term incumbent Bobby Rush by a margin of two to one. In January 2003, Obama became chairman of the Illinois Senate’s Health and Human Services Committee when Democrats, after a decade in the minority, regained a majority. He sponsored and led unanimous, bipartisan passage of legislation to monitor racial profiling by requiring police to record the race of drivers they detained, and legislation making Illinois the first State to mandate videotaping of homicide interrogations. During his 2004 general election campaign for U.S. Senate, police representatives credited Obama for his active engagement with police organizations in enacting death penalty reforms. Obama resigned from the Illinois Senate in November 2004 following his election to the U.S. Senate.

 Accordingly, with both education and practical application on Barack Obama’s resume, there should be little doubt in anyone’s mind that Barack Obama is aware of what is taking place in America today, and every day for the last month. According to the media gasoline prices have risen a minimum of a penny a day, every day for the last 29 days nationwide, with a variety of reasons and excuses too many to recount. Therefore, at least in my opinion, Barack Obama is complacent in the price gouging we are all suffering.

 (W.A.M.) Price gouging is a pejorative term referring to a situation in which a seller prices goods or commodities much higher than is considered reasonable or fair. In precise, legal usage, it is the name of a crime that applies in some of the United States during civil emergencies. In less precise usage, it can refer either to prices obtained by practices inconsistent with a competitive free market, or to windfall profits. In the Soviet union, it was simply included under the single definition of speculation.

The term is similar to profiteering but can be distinguished by being short-term and localized, and by a restriction to essentials such as food, clothing, shelter, medicine and equipment needed to preserve life, limb and property. In jurisdictions where there is no such crime, the term may still be used to pressure firms to refrain from such behavior.

The term is not in widespread use in mainstream economic theory, but is sometimes used to refer to practices of a coercive monopoly which raises prices above the market rate that would otherwise prevail in a competitive environment. Alternatively, it may refer to suppliers’ benefiting to excess from a short-term change in the demand curve. As a criminal offense,Florida’s law is typical. Price gouging may be charged when a supplier of essential goods or services sharply raises the prices asked in anticipation of or during a civil emergency, or when it cancels or dishonors contracts in order to take advantage of an increase in prices related to such an emergency. The model case is a retailer who increases the price of existing stocks of milk and bread when a hurricane is imminent. It is a defense to show that the price increase mostly reflects increased costs, such as running an emergency generator, or hazard pay for workers.

 Laws against price gouging

 In the United States, laws against price gouging have been held constitutional as a valid exercise of the police power to preserve order during an emergency, and may be combined with anti-hoarding measures. Exceptions are prescribed for price increases that can be justified in terms of increased cost of supply, transportation or storage. Statutes generally give wide discretion not to prosecute: in 2004, Florida determined that one-third of complaints were unfounded, and a large fraction of the remainder were handled by consent decrees, rather than prosecution. Proponents of laws against price gouging assert that it can create an unrealistic psychological demand that can drive a non-replenishable item into extinction.

 Therefore, as I read the law, price gouging is a judgment call, the law can choose to protect you, or choose to protect those that are doing the gouging, and sense I would wager that those, oil companies and special interest groups, that are doing the gouging contribute more funds to political campaigns than those of us, i.e., consumers, that are being gouged. Accordingly, I believe that as far as the law, law enforcement, and our government is concerned, those of us, consumers, being gouged can howl at the moon for satisfaction.

 Accordingly, I once again beseech each and every rank and file taxpaying, consuming, American citizen that is less than pleased with the price they are presently paying at their local gas pumps, to join me in 2012 to save America.

 I do not dislike Barack Obama, he may be one of the finest individuals to ever grace the planet, however with that said, I did not believe Barack Obama was the right man to govern Americain in November 2009 and I still hold firm to the same belief today. Simply put, in my opinion a man or a woman working for McDonald’s should be more concerned with the stock in MacDonell’s pantry than he or she is about the stock at Pizza Hut or Burger King.

 As sympathetic as I am for the rank-and-file citizens in Afghanistan, Iraq, Libya, and every other wannabe free Nation in theMiddle East, “they” are all recognized as sovereign nations…

A king, queen, or other noble person who serves as chief of state; a ruler or monarch. b. A national governing council or committee. 2. A nation that governs territory outside its borders. 3. A gold coin formerly used in Great Britain. 1. Self-governing; independent: a sovereign state.

 … Independent sovereign nations, self-governing? What is not to understand? The United States of Americais a sovereign nation. Americais a Democratic Republic, we, “we the people,” elect, i.e., hire, men and women from our ranks to represent us. America did not become America or a Democratic Republic by an intervention from a sympathetic nation somewhere on the planet that believed King George’s taxation was unfair. America became America at the hands of rebellious Americans armed with flintlock’s. America wasn’t born at the UCLA Medical Center, Mayo Clinic or Chicago Hope. America was born on a battlefield, delivered by men with muskets wearing muddy boots, not by individuals in scrubs with sterile forceps. Accordingly I repeat; Americais a sovereign nation, which entitles America to govern itself, being a sovereign nation does not allow America, its leader, or its people, or any other faction within America to govern another sovereign nation.

 Donald Trump, a well-known American, who is presently posturing for a run at the Oval Office recently commented, and I paraphrase; “if we, referring to “we,” as America,” spend our treasury and sacrifice our men and women in the military to detour or destroy evil in the world, “when the smoke clears, “we,” again referring to ““we” as “America,” should enjoy the spoils.” Mr. Trump citing that historically the Victor of a conflict seizes and retains all lands and properties.

 Not to rain on Mr. Trump’s parade, however being an individual that believes human beings were given the power to reason, for a reason? I believe if the folks in whatever nation, at wherever geographical location on the planet are unhappy with their lives, it is their obligation to pick up their muskets and get their boots muddy. A tough line? Absolutely, but then I born in America where my parents and the schools I attended taught personal responsibility.

 Accordingly, it is my personal opinion, that not one single American tax dollar, or one single American life should be spent in deciding the fate of another sovereign nation. However, as I am at the same time an individual who believes in lending a helping hand, I would have no objection whatsoever to any sovereign nation anywhere on the planet making application to join the United States of America. An application that would be considered and voted on not only by the representatives of the people, but an application, a referendum if you will? To be voted on by the population as well, and if accepted, said sovereign nation would become a State, subject to the U.S. Constitution, U.S.taxation and all U.S. laws. Which of course would inturn also entitle the new State to all the rights and privileges guaranteed by our Constitution and our laws. Food for thought.
